New gem and maintaining

We have developed a new patches to the gem for our packaging system in @altlinux. Can I release new version of the gem to rubygems? Since I see the gem isn't being maintained anymore.

It can be modified and redistributed in accordance with the BSD-2-Clause license.

According to https://github.com/rubyworks/setup#copyrights- so I would defer to the license in the project, which seems to allow modification and distribution.

I do not know. I haven't seen any activity from him since the 23rd of Jun, 2020, so hopefully he is just busy.
